Please read these Terms and Conditions carefully. They govern your use of 50x50 Travels’ website, browser-based travel application, games, digital access, and related services.

1. Acceptance of These Terms

These Terms and Conditions (the “Terms”) form a binding agreement between you and 50x50 Travels. By visiting our Website, creating or using an Account, using the Application, redeeming digital access, or purchasing products or services from us, you agree to these Terms.

If you do not agree to these Terms, do not use the Service. Our Privacy Policy also applies to your use of the Service and explains how we collect, use, store, and share personal information.

2. Definitions

Account means an account used to access MapApp, MapApp Premium, or other account-based features of the Service.

Application means the browser-based 50x50 Travels application and progressive web app (“PWA”), including MapApp and Premium features. The Application is currently accessed through the web and is not dependent on download from an app store.

Company means 50x50 Travels, 51 E Jefferson St. #1297, Orlando, FL 32802 (“50x50 Travels,” “we,” “us,” or “our”).

Digital Access means access rights to digital features, including MapApp, MapApp Premium / Full USA access, and any separately offered expansion or add-on entitlements.

Qualifying Gear means a physical 50x50 Travels product that includes MapApp access when the applicable product description expressly says that it does.

Service means the Website, Application, games, travel-planning tools, digital content, account services, and related features we provide.

User Content means content you create, enter, upload, save, or submit through the Service, such as notes, travel plans, stories, field notes, memories, photos, captions, scrapbook content, and feedback.

Website means the 50x50 Travels website located at https://www.50x50travels.com/ and related pages we operate.

You means the person using the Service, or the organization on whose behalf that person is authorized to act.

3. Eligibility, Adult Accounts, and Family Use

You must be at least 18 years old to create or manage an Account, make purchases, redeem access on behalf of a household, or agree to these Terms.

50x50 Travels is designed to be enjoyed by families. A parent or legal guardian may allow minors in the household to use games and travel features under the adult’s Account and supervision. Minors should not create their own Accounts, make purchases, or independently submit personal information to us. The adult Account holder is responsible for supervised use of the Service through that Account.

If applicable law gives you consumer rights that cannot be waived or limited by contract, these Terms do not override those rights.

4. Accounts and Account Security

Certain features require an Account. You agree to provide accurate information when creating or using an Account and to keep your sign-in method and Account access reasonably secure.

The same Account may be used on more than one supported device. The Account holder remains responsible for activity through the Account and should not publicly share, sell, rent, or misuse Account credentials or Digital Access.

5. Purchases, Physical Goods, and Digital Access

We sell physical products and may sell one-time Digital Access through our Website. Purchases are completed through our website checkout and the payment services made available there. Prices, taxes, shipping charges, and any product-specific terms shown at checkout are part of your purchase.

At launch, 50x50 Travels does not use recurring subscription billing for MapApp or MapApp Premium. Unless an offer expressly says otherwise:

·        a qualifying gear purchase may include MapApp access as described on the product page;

·        MapApp Premium / Full USA access may be offered as a separate one-time digital purchase or as part of a clearly described bundle;

·        future expansions or add-ons may be sold as separate one-time purchases; and

·        a one-time access purchase will not automatically convert into a recurring subscription without your separate, express agreement.

Digital Access is tied to the applicable Account and entitlement record. Claim or redemption codes may be single-use or subject to limits stated with the code or offer. You may not manipulate, duplicate, sell, or misuse access codes or attempt to bypass entitlement controls.

We may update, add, remove, or revise individual features over time for maintenance, security, technical, legal, or product reasons. A one-time purchase or one-time entitlement means that we do not charge a recurring subscription fee for that entitlement as sold and that the entitlement has no scheduled expiration date. It does not mean “lifetime access,” guarantee that every feature or item of content will remain unchanged, or guarantee that the Service, hosting, servers, third-party dependencies, or 50x50 Travels will operate indefinitely.

6. Shipping, Returns, Refunds, and Order Issues

Shipping and delivery dates are estimates and may be affected by carriers or circumstances outside our control. If an order arrives damaged, is incorrect, or does not arrive as expected, please contact us promptly so we can review the issue.

Return, exchange, cancellation, and refund eligibility is governed by our Return, Refund & Digital Access Policy displayed on our Website, product page, checkout, or other purchase terms in effect when you place the order, together with any rights required by applicable law.

If a digital purchase is refunded, the related Digital Access may be revoked as part of reversing the purchase.

Payment processors and other checkout providers may impose their own processing, timing, or refund limitations. We do not store complete payment-card numbers in the Application.

7. License to Use the Service

Subject to these Terms and your applicable Digital Access, 50x50 Travels grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for personal and household travel, entertainment, planning, and memory-keeping.

This license does not permit you to copy, resell, sublicense, commercially exploit, scrape, republish, reverse engineer, or create derivative commercial services from the Service except where applicable law expressly allows such activity despite this restriction.

8. User Content

The Service allows you to create or upload User Content. You retain ownership of your User Content.

You grant 50x50 Travels a limited, worldwide, non-exclusive license to host, store, reproduce, process, format, transmit, and display your User Content only as reasonably necessary to operate, secure, synchronize, back up, troubleshoot, and provide the Service.

Where an export or download feature is available, you may use it to save supported User Content for your personal records. Export tools may not include every type of data, locally stored item, cached asset, or unsynchronized content.

If a feature clearly allows you to intentionally submit content for sharing with other travelers, you also grant us permission to display and distribute that submitted content through that feature. We do not treat private notes, private scrapbook content, or private photos as public merely because they are stored in the Service.

You are responsible for User Content you submit and represent that you have the rights needed to use and upload it. Do not upload content that is unlawful, infringes another person’s intellectual-property or privacy rights, contains malicious code, or is otherwise prohibited by these Terms.

9. Intellectual Property and 50x50 Content

Except for User Content and third-party materials, the Service and its original content, software, game concepts and implementations, graphics, maps and visual presentations, logos, branding, designs, text, photographs, artwork, and other materials are owned by or licensed to 50x50 Travels and are protected by intellectual-property laws.

The 50x50 Travels name, logos, product names, designs, and other brand elements may not be used in a way that suggests sponsorship, endorsement, or affiliation without our permission.

If you believe material on the Service infringes your copyright or other intellectual-property rights, contact adventurecalls@50x50travels.com with enough information for us to review the concern.

10. Feedback and Suggestions

If you voluntarily send us ideas, suggestions, bug reports, feature requests, or other feedback, you give us permission to use, adapt, and implement that feedback for any lawful business purpose without compensation, credit, or obligation to you. This does not transfer ownership of your unrelated User Content or personal travel memories.

11. Acceptable Use

You agree not to misuse the Service. For example, you may not:

·        attempt to gain unauthorized access to Accounts, systems, data, or non-public areas of the Service;

·        bypass, defeat, tamper with, or interfere with authentication, entitlement, claim-code, security, or access controls;

·        probe, scan, overload, disrupt, damage, or introduce malicious code into the Service;

·        use automated scraping, bots, or bulk extraction methods except with our written permission;

·        impersonate another person or use another person’s Account without authorization;

·        use the Service to violate law or the rights of others; or

·        copy or commercially exploit our protected content or software except as expressly permitted by us or by law.

12. Offline Use, Device Storage, and Synchronization

Some features can be prepared for offline use. Offline functionality may use browser or device storage, including local storage, IndexedDB, Cache Storage, and downloaded asset packs.

When you work offline, some changes may be saved to your device first and synchronized to cloud services after connectivity returns. The Service may distinguish between content saved on your device and content backed up to the cloud.

You are responsible for maintaining reasonable device storage and for avoiding deletion of browser/app data when you have unsynchronized work. Clearing site data, uninstalling or resetting the browser/app, device-storage eviction, private-browsing limitations, or device failure may remove locally stored data or offline packs before they are synchronized or redownloaded.

Offline availability can vary by feature. Some functions, including first-time sign-in, new purchases or claim redemption, certain online services, and new route generation, may require an internet connection. Large optional offline packs may require additional download time and storage and may need to be downloaded again after updates or browser-storage eviction.

13. Travel, Routing, and Informational Content

50x50 Travels provides travel ideas, games, route-planning tools, destination information, and user-created content for informational and entertainment purposes. Travel conditions change. Roads may close, businesses may change hours or close, events may be cancelled, weather may create hazards, and map or location data may be incomplete or outdated.

Route suggestions in the Are We There Yet? game, content, maps, mileage, timing, nearby places, and travel prompts are not a substitute for official road signs, emergency instructions, current weather and closure information, local law, or your own judgment. Always verify important travel information with appropriate official or current sources and do not use the Service as an emergency-navigation or safety service.

You are responsible for safe travel decisions, vehicle operation, supervision of children, and compliance with traffic, park, venue, property, and local rules. Do not interact with the Service while driving in a way that distracts you or violates law.

14. Third-Party Services and Links

The Service may depend on or link to third-party services, websites, maps, payment processors, hosting providers, authentication providers, email providers, media services, or other external resources. Third-party services are governed by their own terms and privacy practices.

We do not control third-party availability, content, security, or practices and are not responsible for losses caused solely by your use of a third-party service. Links do not necessarily mean that we endorse the third party.

15. Service Availability, Updates, and Changes

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or indefinite availability. Maintenance, device limitations, connectivity, browser changes, storage limits, third-party outages, security incidents, technological changes, legal requirements, business conditions, or other circumstances can affect availability or performance.

We may release updates, change technical requirements, replace assets, revise content, modify features, temporarily suspend features, or discontinue some or all of the Service when reasonably necessary. This may include circumstances involving security, maintenance, legal compliance, third-party service availability, technological changes, business closure, insolvency, or circumstances that make continued operation impracticable.

Where reasonably possible, we will provide advance notice of a planned material discontinuation. If the Service provides a download or export feature, we may also provide a reasonable opportunity to export supported User Content before shutdown where technically feasible. You are encouraged to use available export tools periodically for travel memories or other information you wish to preserve independently.

A one-time purchase or entitlement does not have a scheduled expiration date and does not automatically renew. It is not a promise that the Service will be hosted or operated forever. Except where required by applicable law or expressly stated in purchase-specific terms, later modification, suspension, or discontinuation of the Service does not by itself create an obligation to refund purchases made in prior periods solely because future access is no longer available.

Offline packs and cached content may need to be refreshed after an update. Some downloaded or device-local functionality may also depend on browser, device, licensing, security, or technical requirements and is not guaranteed to continue functioning after the Service is discontinued.

16. Promotions and Special Offers

If we offer a contest, sweepstakes, giveaway, discount, festival promotion, or other special offer, additional rules or eligibility terms may apply. If separate promotion rules conflict with these Terms for that promotion, the promotion-specific rules control.

17. Termination and Suspension

We may suspend or terminate access to the Service when reasonably necessary because of a material breach of these Terms, fraud, abuse, security risk, unlawful activity, misuse of access or claim codes, or conduct that threatens the Service or other users.

Where practical and appropriate, we may provide notice or an opportunity to resolve the issue. We may act immediately when necessary for security, legal compliance, fraud prevention, or protection of users.

Termination does not eliminate obligations that by their nature should survive, including intellectual-property protections, warranty disclaimers, liability limitations, and dispute provisions.

18. “AS IS” and “AS AVAILABLE” Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED, WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will always be uninterrupted, error-free, compatible with every device or browser, or free from data loss, or that travel information, user content, maps, routes, or third-party information will always be complete, current, or accurate.

Nothing in these Terms limits any express product warranty or mandatory consumer right that applies and cannot lawfully be excluded.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 50x50 TRAVELS AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, BUSINESS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR A PURCHASE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO 50x50 TRAVELS FOR THE PRODUCT OR DIGITAL ACCESS GIVING RISE TO THE CLAIM OR (B) $100.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Before filing a formal claim, you agree to contact us and make a reasonable good-faith effort to resolve the dispute informally. Unless applicable law requires a different forum, disputes that cannot be resolved informally will be brought in a court of competent jurisdiction located in Orange County, Florida.

Nothing in this section prevents either party from seeking appropriate emergency or injunctive relief where legally available.

21. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will show when the Terms were most recently revised. When required by law, or when a change is material to your rights or obligations, we will provide reasonable notice through the Website, Application, email, or another appropriate method.

Your continued use of the Service after revised Terms become effective means you accept the revised Terms to the extent permitted by law. If you do not agree, stop using the Service.

22. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible.

A failure to enforce a provision of these Terms is not a waiver of the right to enforce it later.

23. Entire Agreement

These Terms, our Privacy Policy, applicable product or purchase terms, and any separate rules expressly incorporated by reference constitute the agreement between you and 50x50 Travels regarding the Service. If a product page, checkout term, promotion rule, or other specific term expressly conflicts with these Terms for that transaction or feature, the more specific term controls for that subject.
